CLARITY Act Senate Vote Expected Next Week

CLARITY Act Senate vote could happen as early as next week. Former CFTC Commissioner Summer Mersinger shared this update.

She is also the CEO of the Blockchain Association. Momentum is growing as the August recess deadline approaches.

Why CLARITY Act Senate vote matters

Mersinger spoke on the Thinking Crypto podcast. Lawmakers are working to finalize the bill.

The Senate Banking and Agriculture Committees are merging their versions. They are combining two proposals into one. Lawmakers are also working out remaining details.

Democrats continue opposing the bill. The ethics provisions debate remains a sticking point.

“We’re in the process of merging the bills,” Mersinger said. Lawmakers are “negotiating some of the last-minute issues.”

Mersinger expects a Senate vote “probably early next week.” The vote will test support for the bill. Supporters need to overcome the 60-vote cloture threshold.

“We’re at the one-yard line right now,” she said. “I feel like we can get it across the finish line.”

Ethics provisions remain one of the largest issues. President Trump met with Republican senators this week. They discussed the ethics piece.

“My understanding is this is on the ethics piece,” Mersinger said. “You’ve got to have an ethics deal that the president will sign.”

Stablecoin yield debate in focus

Mersinger also commented on banking group concerns. Banks are still lobbying senators. Nevertheless, their influence has diminished after earlier negotiations.

“Crypto gave up a lot in that yield agreement,” she noted. “It was not a win for crypto.”

Many lawmakers believe banks already shaped the language. “People really aren’t interested in reopening that agreement,” Mersinger said.

She dismissed claims about deposit flight from banks. “The argument of deposit flight just makes no sense at all,” she said.

Community banks serve different customers. Stablecoin reserves would remain within the banking system.

She warned that delaying the bill could be costly. Passage becomes harder after the August recess.

“It does get a lot harder going into the election season,” Mersinger said. A lame-duck Congress could also complicate matters.

“This window is… probably all the stars are aligned,” she said. “This is the time to do it.”

Looking beyond the CLARITY Act

Mersinger recognized the next legislative priority. Crypto tax reform will likely follow.

“We kind of view it as a three-legged stool,” she said. Stablecoins was first, CLARITY is second, and then tax reform.

Updating tax rules is “critically important.” The existing tax code “was not written for digital assets.”
